1. Who these terms are with

BentoPlan is operated by Lihtar Ventures UG (haftungsbeschränkt), Kolonnenstraße 8, 10827 Berlin. The full company details are in the imprint.

The service is offered to businesses only, in the sense of § 14 BGB. It is not offered to consumers, and signing up on behalf of a venue means you are entitled to do so.

These terms are the whole of the agreement. Your own purchasing conditions do not apply, even if we do not contradict them.

2. What the service is

BentoPlan produces a statistical forecast of demand for a hospitality venue — expected orders and revenue for the days ahead — from the trading history you enter or connect, together with weather and public event data.

3. What a forecast is not

A forecast is an estimate expressed as a range, not a promise. It is wrong on some days by construction, and it is wrong by more on days that do not resemble the days before them. Decisions about purchasing, production and staffing remain yours.

Every forecast we send you is shown against what you actually took, the following morning, so you can judge for yourself how well it is working.

4. Your account

One organisation, one account. You are responsible for what happens under it, including what the people you invite can see: anyone you add to a venue sees that venue's figures. Tell us as soon as you suspect a login has been compromised.

5. Your data

The trading figures you enter remain yours. What we do with them is set out in the privacy policy: we store daily totals, not transactions, and never guest records.

We do not reconcile your reported takings against anything, produce variance reports, or otherwise build a tool that could be used to audit you or your staff. That is a product decision, and it is permanent.

Where we process personal data on your behalf — the colleagues you invite, and your staff once scheduling exists — a data processing agreement under Art. 28 GDPR applies. Ask and we will send it.

6. What you may not do

Do not resell or sublicense access, reverse engineer the service, or use it to build a competing forecasting product. Do not scrape it, and do not call the API beyond what running your own venues requires.

Do not put personal data about your guests into it. The service is not built to hold it, and the privacy policy says so on purpose.

7. Subscription and billing

Prices are per venue, per month, exclusive of VAT, as listed on the pricing page. The free tier is not a trial and does not expire.

A paid subscription begins when you select a tier in the app and it is confirmed. It runs month to month and renews each month until cancelled. Payment is taken at the start of each month by Stripe; if it fails, we will tell you, and may suspend access if it stays unpaid. Suspension does not delete anything.

We may change prices with effect from a following month, and will tell you at least 30 days beforehand. If a change does not suit you, cancel before it takes effect.

8. Availability

We commit to 99.5% availability per calendar month, on every plan including the free one. That allows for roughly three and a half hours down in a month.

Availability is measured against the app and the API. Announced maintenance does not count against it, nor does anything outside our control: your connection, your own systems, or a third party we depend on being down. Maintenance that takes the service down is announced in advance where the work allows it.

A forecast is delivered as a daily notification, so an outage during the day costs you a page you can read later. Miss the evening delivery window and you miss the forecast for the next morning, which is the case we hold ourselves to.

9. Liability

We are liable without limit for damage caused intentionally or by gross negligence, for injury to life, body or health, and wherever the Produkthaftungsgesetz applies.

For simple negligence we are liable only for breach of a duty whose fulfilment makes performing this contract possible at all and on which you may reasonably rely, and then only for the foreseeable damage typical of an agreement of this kind, limited to the fees paid in the twelve months before the event and in no case exceeding €5,000.

A forecast is only as good as what it is given. Liability presupposes that the venue was set up and used as the product documentation describes: opening hours and closing days kept current, a day the venue did not trade marked closed rather than left blank or entered as zero, takings entered for the business date they belong to, and the service used for the venue it was configured for. To the extent damage results from configuration that is wrong or out of date, or from use contrary to the documentation, our liability is reduced or excluded under § 254 BGB.

Any further liability is excluded. This covers in particular what you decide on the strength of a forecast, which section 3 is about.

10. Termination

You may cancel at any time, effective at the end of the paid month. Cancelling in the app or by email is enough; we ask for nothing more formal.

Either of us may terminate for good cause under § 314 BGB.

You can export your records before you go; we do not hold your history hostage. After the account closes your data stays available for 30 days, and is then deleted along with everything derived from it.

11. Changes to these terms

We may change these terms. You will hear at least 30 days before a change takes effect, together with what it changes. If it does not suit you, either of us may end the contract as of that date.

12. Governing law

German law, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Berlin.
